1. Service Description
NexusGate LLC ("NexusGate," "we," "us," or "our") provides B2B outbound prospecting and appointment-setting services for managed IT services providers (MSPs), managed security services providers (MSSPs), and commercial IT consultancies.
Our service includes target-account research, human-led outbound calling, qualification screening, and calendar booking of held meetings.
2. Communications Consent
By engaging our services, providing your telephone number, or submitting an inquiry form on our website, you expressly consent to receive telephone calls, text messages (SMS), and emails from NexusGate and its representatives regarding our services.
Consent is not a condition of purchase. You may decline to receive marketing or sales communications at any time without affecting your ability to use our services.
3. SMS & Telephone Communications (A2P 10DLC / TCPA)
NexusGate operates its messaging and calling campaigns in compliance with the Telephone Consumer Protection Act (TCPA) and A2P 10DLC industry standards.
Message Frequency
The number and frequency of messages depends on the nature of the engagement. A typical outbound campaign involves 3–5 touch points over a 2-week cadence. You may receive follow-up calls, SMS reminders for scheduled meetings, and service-related communications.
Opt-Out
You may opt out of SMS communications at any time by replying "STOP" to any text message you receive from us. You may opt out of telephone calls by informing our representative during any call or by emailing ervin@nexusgate.tech. We will process opt-out requests within 5 business days.
Standard Rates
Standard message and data rates from your mobile carrier may apply to SMS communications. NexusGate does not charge for SMS messages, but your carrier may.
Compliance
NexusGate registers its messaging campaigns with The Campaign Registry as required by A2P 10DLC. Our campaigns are vetted for compliance with carrier guidelines, TCPA regulations, and CTIA industry best practices.
4. Use of Data
Personal information collected during outreach, including names, phone numbers, email addresses, and company details, is used solely for the purpose of service delivery, qualification, and follow-up. We do not sell personal information to third parties. See our Privacy Policy for full details.
5. Fees & Payment
Service fees are as agreed in the statement of work or service agreement between NexusGate and the client. Our standard model is a monthly retainer plus a per-meeting fee for held qualified meetings, as described on our website and confirmed in writing.
Invoices are due within 30 days of receipt. Late payments may result in suspension of services.
6. Intellectual Property
All materials, methodologies, lists, and processes developed by NexusGate in the course of providing services remain the intellectual property of NexusGate. Client data and confidential information remain the property of the client.
7. Limitation of Liability
NexusGate provides its services on an "as is" and "as available" basis. To the maximum extent permitted by law, NexusGate disclaims all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. NexusGate's total liability for any claim arising from these terms or the services shall not exceed the fees paid by the client in the 12 months preceding the claim.
8. Termination
Either party may terminate the service agreement with 30 days' written notice. NexusGate reserves the right to suspend or terminate services for non-payment or material breach of these terms.
9. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising from these terms shall be resolved exclusively in the courts of Delaware.
